We are pleased to invite you to our next seminar that we are holding with Addleshaw Goddard, entitled Protect Your Privilege.

This session will be a practical seminar exploring the effect of the decision of a recent case on privilege between a client and lawyer. In this decision, the Court has restricted the definition of "client" for the purpose of legal advice privilege which has an impact for all in-house lawyers.

We will cover a summary of everyday issues which are now relevant for in-house lawyers from recent caselaw including the RBS Rights Issue Litigation [2016] EWHC 3161 (Ch) along with practical tips on:

  • The different types of privilege and how you can protect it;
  • Pitfalls of pre-emptive internal investigations and how privilege can be lost;
  • Practical examples of how privilege is in practice now for situations including:
    • Whistle blowing and competition investigations;
    • IT / HR External Consultant Reports; and
    • Regulatory investigations (such as investigations by the FCA).


The seminar will provide an opportunity for you to engage in Q&As during the event and at the close. In addition, at the conclusion you will be provided with practical take-away points to protect your privilege

Ben Lowan

Ben is a Partner in the financial and fraud dispute resolution / litigation team. Ben's experience involves all aspects of finance litigation, be it bringing claims for financial services clients and defending claims against those clients. Ben acts for many clients in both the asset finance and invoice discounting sectors. Ben also acts for mortgage lenders, principally in professional negligence claims against solicitors and valuers and in contested possession claims. Ben has a particular specialism in dealing with fraud claims and asset recovery, both in the financial services sector and for commercial organisations. This often involves taking urgent action to obtain freezing injunctions and search orders.

Ben was seconded for 6 months to Nationwide Building Society in the role of Senior Counsel in Dispute Resolution. Ben principally advised the Commercial Division of Nationwide in respect of their high value and complex disputes arising out of their commercial lending.

Ben advises clients on issues of anti-money laundering and anti-bribery and corruption. Ben is Addleshaw Goddard's Anti-Bribery and Corruption Officer and is a Money Laundering Reporting Officer. Ben is also a certified Fraud Examiner.

Bill Gilliam

Bill is a Partner in the commercial dispute resolution/litigation team. He specialises in heavyweight disputes and has particular expertise in the management and resolution of procurement challenges, major IT project disputes, shareholder disputes, claims arising from the sale and purchase of businesses and the resolution of large-scale business-critical supply/joint venture (JV) disputes.

Bill has an enviable track record of success in litigation and arbitration, together with all forms of alternative dispute resolution (ADR), including expert determination, negotiation and mediation.

He acts for national and international clients and has considerable experience of advising both private and public bodies in a range of sectors, including health, transport, retail, utilities and technology.

Clare Walker

Clare is an associate in the competition team and specialises in all aspects of competition law. She advises clients across a range of sectors, including retail and consumer, financial services, industrials, regulated sectors and utilities. Clare's experience includes market investigations and sector inquiries, most recently acting for a major bank on the Competition and Markets Authority's retail banking market investigation

Ben Oliver

Ben is an associate in our litigation team and specialises in banking and finance litigation. Ben acts for Banks, Building Societies and Asset Finance/Invoice Finance lenders in relation to all aspects of litigation, including secured and un-secured debt recovery particularly in relation to commercial banking finance. Ben has experience of both bringing claims for financial services clients and defending claims against those clients, including complex recovery actions (including un-due influence, economic duress, misrepresentation) and allegations of misrepresentation and mis-selling of various financial products.
